No automated decision-making in individual cases by JobConnector / support by artificial intelligence

JOBCONNECTOR uses artificial intelligence (“AI”) so that personal data is searched and CVs are compared with jobs / positions in the context of personnel placement or placement of self-employed consultants (non-employees of JOBCONNECTOR) and temporary workers (employees of JOBCONNECTOR) in order to to find suitable jobs/positions. For this purpose, JOBCONNECTOR uses a service from Textkernel BV, Nieuwendammerkade 26a5, NL-1022 AB Amsterdam ("TK"), a company based in the Netherlands / EU.

In general, AI describes computer systems that are able to perform tasks that normally require human intelligence. JOBCONNECTOR processes your data in the case of recruitment or placement as an independent consultant on the basis of the legitimate interest pursuant to Article 6 Para. 1 S. 1 lit f GDPR, since it is in your and our mutual interest to find suitable jobs / positions, and in the case of temporary workers on the basis of § 26 BDSG.

This AI helps our recruitment consultants to search and match proposed candidates with our clients' vacancies more efficiently. The benefit of the AI search feature is that it helps our recruiters search through more resumes and match personal data to client job offers faster, while ignoring irrelevant data. Our recruitment consultants are presented with a list of suggested candidates for a client's vacancy. However, this does not lead to automatic decision-making. Our recruiters decide which candidates to shortlist for a particular client position based on their expertise, knowledge of the job market, insight into the client's business and job requirements, interviews with the candidates and other relevant criteria come.

If anything, clients decide (through their recruiters) which candidates they choose to interview. Our clients' hiring managers (and not our AI tool) make the final decision on which candidate to select for the job, if a suitable candidate exists, and then take care of hiring the candidate.

You can object to the processing by TK AI at any time by contacting info@job-connector.de turn around. In this case, we will no longer use TK AI in relation to your CV. This has no consequences or effects, especially not on your application or on the search for suitable positions for you, as we use our personal knowledge about you, the customer and his business, the position and the requirements of the role and the market at all times and make every decision alone.

If you object to the processing of your personal data by our AI tool, our recruiters will continue to provide you with job placement services, but will use other methods to find job opportunities for you. The personal data of applicants who are no longer available for employment, who are no longer actively looking for a job, who have recently taken up permanent employment or who have objected to the processing of their personal data by AI will be processed by our AI service provider deleted

More information about our AI tool can be found here. If you wish to object to the processing of your personal data by our AI tool and/or have further questions, please contact info@job-connector.de.

Alternatively, we may seek to acquire or merge with other companies. Should our business change, we will let you know.
  • To IT consultants who carry out testing and development work on our IT systems, to service providers commissioned by us with data processing and other service providers who may also be based outside the EEA.

We may impose appropriate contractual, security, confidentiality and other obligations on third party suppliers and processors we engage, depending on the nature of the services they perform for us. We only allow them to process your personal data if they do so in compliance with the law and our instructions. We do not allow them to use your personal information for their own purposes. If our relationship with these service providers ends, we will ensure that your personal information is returned securely or destroyed (or anonymised so that you can no longer be identified).

Some of these third parties are also controllers responsible for processing your personal data for their purposes, for example the local tax authority acts as a controller for tax purposes. We may not be able to impose obligations or restrictions on these controllers in relation to how they process your personal data.

Due to the global activities of our customers, your personal data can be accessed worldwide (although some recipients may be in countries that do not have a data protection level that corresponds to the European data protection level) by our customers' employees, including their IT administrators, and possibly for processing commissioned service providers who need to know this data in an appropriate manner for the purposes stated in this data protection declaration. You are therefore aware that your personal data is transmitted to recipients in third countries without an adequate level of data protection and that it is collected, processed, stored and used by our customers and, if applicable, their service providers. To protect your personal data, our customers have assured us that they have taken appropriate security measures to protect this data.

Secure storage of your personal data

We have put in place appropriate security measures to prevent your personal information from being accidentally lost, used, accessed, modified or disclosed in an unauthorized manner. In addition, we limit access to your personal information to those employees, agents, contractors and other third parties who have a business need to know.

We have put in place procedures to deal with any suspected personal data breach and we will notify you and the applicable regulator of a breach where we are legally required to do so.

How long do we store your personal data?

JobConnector retains your personal data for as long as is necessary to fulfill the purposes we have collected. This means that we retain your personal data throughout the period of your relationship with us and while we are providing you with staffing services (temping, recruitment and/or the provision of independent consultants).

If you no longer wish to use our personnel services, you can ask us to delete your personal data from our applicant database. After we have deleted your information, we may retain your name and email address on our suppression list and, depending on the services we have provided to you, parts of your personal information for our legitimate business interests described below.

If we have not found a job for you, your data will be stored for up to 2 years after the last contact. After this period you will be contacted again to decide whether you wish to continue to be registered with us. After the two-year retention period has expired, we anonymize the personal data in our database so that we can no longer identify you.

If we have mediated a job or an order for you, we will store your personal data for the duration of your employment relationship or the duration of your assignment with a third party as an independent consultant based on a mediation that took place before us and in accordance with our legal obligations. After this period you will be contacted again to decide whether you wish to continue to be registered with us.

We are required by law to retain basic information about our customers (including contracts, proof of identity, financial and transactional data) for legal, compliance and tax purposes for up to 10 years after our relationship has ended.

Unless a retention period is required by law, we will determine the appropriate retention period for personal data, taking into account all relevant criteria.

In certain circumstances we anonymise your personal data (so that it can no longer be linked to you and we cannot identify you). We do this for research or statistical purposes. In this case, we can use this anonymized data indefinitely without informing you.

You can request details of the retention periods for different aspects of your personal data by sending an email to: info@job-connector.de.
